T&Cs

Terms and Conditions (T&Cs)

of Mint Kiteboarding di Felix Federl

1. Conclusion of Contract

By making a booking, the participant submits a binding offer to conclude a contract. Bookings may be made verbally on site, by telephone, via email, or using the booking form on the Mint Kiteboarding website.

The contract becomes effective upon receipt of the booking confirmation by the participant. The confirmation is not subject to any specific form. When booking via the Mint Kiteboarding website, the contract is concluded upon display of the booking confirmation on the screen.

For minors, bookings must be made by a parent or legal guardian. In this case, the contract is concluded with the legal guardian on behalf of the minor.

If the participant has not received confirmation at least 4 days before the start of the booked service, the participant must contact Mint Kiteboarding immediately.

If a participant makes a booking for additional persons, the booking participant acts as their representative and is responsible for informing all additional participants about these Terms and Conditions and any other contractual provisions.

2. Payment

All prices stated are gross prices and include applicable statutory VAT.

Payment becomes due upon receipt of the booking confirmation and must be made within 14 days. For short-notice bookings, payment must be made no later than 1 day before the start of the booked service.

For bookings made on site, payment is due immediately.

Mint Kiteboarding reserves the right to deny participation if full payment has not been received.

3. Services and Weather-Dependent Operation

The scope of contractual services is defined by the descriptions on the Mint Kiteboarding website and the booking confirmation.

As kitesurfing is a wind- and weather-dependent outdoor activity, courses and activities can only take place under suitable weather and wind conditions.

Wind and weather conditions are not part of a guaranteed service.

If individual course days cannot take place due to unsuitable wind or weather conditions, no refund will be issued for services that could not be carried out.

Instead, the following rules apply:

  • A corresponding value credit will be issued for services that could not be carried out

  • Alternatively, if possible, missed sessions may be rescheduled during the stay

  • By agreement, equivalent alternative activities (e.g., wakeboarding, foiling behind the boat, or boat tours) may be offered

  • Value credits are valid for 3 years

  • Vouchers are transferable

4. Cancellation by the Participant

The participant may withdraw from the contract at any time before the start of the booked service.

Cancellation must be submitted in writing or in text form, stating the participant’s name and the start date of the booked service.

The decisive date is the date of receipt of the cancellation notice.

The following cancellation fees apply:

  • Up to 14 days before start: free of charge

  • From 13 days before start: 30% of the price

  • From 10 days before start: 50% of the price

  • From 5 days before start: 70% of the price

  • From 1 day before start: 90% of the price

  • No-show without cancellation: 100% of the price

The participant retains the right to prove that no damage or significantly less damage has occurred.

5. Rescheduling

Participants may request rescheduling up to 14 days before the start of the booked service.

A new date can only be granted subject to availability.

If rescheduling results in a price difference, the participant must pay the difference.

Rescheduling is possible within the current season.

6. Termination by Mint Kiteboarding

Mint Kiteboarding reserves the right to terminate the contract without notice if a participant significantly disrupts the course or endangers safety despite prior warning.

This applies in particular in cases of:

  • Ignoring safety instructions

  • Dangerous behavior

  • Serious misconduct toward participants or staff

In such cases, no refund will be issued.

7. Health and Safety

Each participant is required to inform the provider of any health conditions or risks that may affect safe participation.

Participation requires adequate physical fitness and swimming ability.

Participation takes place at the participant’s own responsibility and in compliance with applicable safety rules.

Further details are regulated in the participant agreement.

8. Participant Agreement

The participant agreement includes in particular:

  • Participant details

  • Risk disclosure

  • Health and fitness information

  • Safety rules

  • Liability information

  • Use of equipment

  • Information on photo and video recordings

  • Shuttle services and supervised riding

The participant agreement forms part of the contract and must be signed before the start of the service.

9. Liability

Mint Kiteboarding is liable only for damages resulting from intentional or grossly negligent conduct.

In cases of slight negligence, Mint Kiteboarding is liable only for breaches of essential contractual obligations and limited to foreseeable, typical damages.

Participation in the offered services is generally at the participant’s own risk.

10. Data Protection

Personal data is processed exclusively for the purpose of fulfilling and administering the contract.

Further information regarding the processing of personal data can be found in the separate Privacy Policy on the website.

11. Severability Clause

If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by a provision that comes as close as possible to the economic purpose of the invalid provision.

12. Applicable Law and Jurisdiction

Italian law applies to the contractual relationship.

The place of jurisdiction, insofar as legally permissible, is the registered office of Mint Kiteboarding.

Mandatory statutory consumer protection provisions remain unaffected.
